How do we go about dividing property and other assets?

If you are able to reach agreement on how assets and property is to be divided, you will be able to formalise your agreement by seeking consent orders in the Family Court.

If you are unable to reach an agreement outside of court, you can apply to court for financial orders, including orders relating to the division of assets and property.

What is a settlement agreement? How do I organise one?

Settlement Agreements also known as Prenuptial Agreements or Financial Agreements, are legally binding agreements regarding financial arrangements in the situation where a marriage or de facto relationship breaks down. These can be entered into before, during or after a relationship.

To be legally binding, both parties much have sought independent legal and financial advice and have signed the agreement.

I’m in a de facto relationship - what are my rights?

De facto couples who have separated after 1 March 2009 have the same property and maintenance entitlements as separating married couples. This includes de facto couples in same sex relationships.
